“We were the only J.D. program in China. Fifteen years later, we are just as unique. We remain the only J.D. program in China and the only one that has a resident, multinational faculty,” Prof. Mark Feldman, interim dean of the Peking University School of Transnational Law (STL), introduced to Shenzhen Daily during an interview.
“15年前，我们是中国国内唯一一所提供美国法律培养模式（J.D.）的法学院。15年过去了，我们依然独树一帜。不仅是唯一一所提供美国法律培养模式的法学院，同时也是唯一一所拥有多国籍常驻法学师资力量的法学院。”北京大学国际法学院执行院长马克·费尔德曼教授在一次采访中向英文《深圳日报》介绍。
He added that with 15 years on and more than 1,000 alumni, STL is transitioning to become a more mature institution, and he believes that the support of alumni will “bring the school to the next level.” Prof. Feldman had an exclusive interview with Shenzhen Daily in his office last November.

STL celebrated its 15th anniversary last October. In the school's 15-year history, Prof. Feldman, who has spent 12 years as a Professor of Law, said that it is the school's growing alumni and their support that make him feel more connected with the school and confident about the school's future development.
2023年10月，北京大学国际法学院（STL）迎来创院15周年。费尔德曼教授已在这里工作了12年。他表示，随着校友群体不断壮大，校友们的关心与支持让他的心与学校靠得更近，并对学校的未来充满信心。
Prof. Feldman joined STL in 2011 as an Assistant Professor of Law. His research areas include multinational enterprises, international investment and dispute resolution, and China as a rule-maker and institution builder. Since joining the school, his dedication to teaching has inspired over 1,000 students, and his guidance as a thesis advisor has nurtured the intellectual growth of more than 100 STL graduates.
费尔德曼教授于2011年加入北京大学国际法学院，担任法学助理教授。他的研究领域包括跨国企业、国际投资与争端解决，以及作为规则制定者和机构建设者的中国。加入学院以来，费尔德曼教授教过1千多名学生，指导了100多名学生的毕业论文。

STL committed to producing global legal talent

In 2008, STL was founded in Shenzhen with the vision to provide graduate level, professional legal education in China modeled after the U.S. Now STL provides dual degree J.D./J.M. curriculum that features complex corporate and regulatory topics, commercial and international dispute resolution, and comparative legal traditions taught by an exceptionally distinguished multinational faculty. According to interim dean, the school’s class size has increased from 50 to 60 students 10 years ago to the current 150 students with each incoming class.
2008年，北大国际法学院正式在深圳创办，旨在把美国法律培养模式下的法律研究生教育引入中国。如今，北大国际法学院提供美国法律培养模式（J.D.）和中国法律硕士培养模式（J.M.）课程，涵盖复杂的企业和监管议题、商事和国际争端解决以及比较法律传统，由一支国际知名多国籍常驻法学教授队伍授课。据费尔德曼教授介绍，学院的班级规模已从十年前的50至60人增加到现在的150人。
“We are a Chinese law school with a strong international presence. We have our resident faculty include nationals from South Korea, the U.K., Greece, and the U.S.” Prof. Feldman shared with Shenzhen Daily, “And we thrive in this environment. We really are all drawn to this idea of people from different cultures with different social norms, and different ways of communicating.”

In 2007, Prof. Hai Wen, one of China’s leading development economists and the past Chancellor of Peking University’s Shenzhen Graduate Campus, proposed to establish an innovative graduate-level professional law curriculum in Shenzhen. The following year, Peking University’s new School of Transnational Law was founded and admitted its first students. The University appointed Jeffrey Lehman, former president of Cornell University and dean of the University of Michigan Law School, as STL’s founding dean.
2007年，中国知名发展经济学家、北京大学深圳研究生院前院长海闻教授提议在深圳建立创新性专业法律研究生教育。次年，北京大学新设立的国际法学院正式创立，并招收了第一届学生。北京大学任命曾任康奈尔大学校长、密西根大学法学院院长的杰弗里•雷蒙担任创院院长。
STL offers an American-style J.D. degree taught in English alongside a Chinese J.M. degree, as well as an LL.M. (Master of Laws) degree taught in English. These degree programs are rich in courses emphasizing transnational law and practice, Chinese law and legal traditions, and other cutting-edge courses designed to equip STL graduates of all nationalities for leadership in the 21st century.

In terms of graduates placement, as Prof. Feldman introduced, in the early days, STL graduates would go to international law firms that had offices in China, and as time goes by, the graduates also go to international and Chinese law firms, government offices, and international organizations. He stressed that with more attention on the Guangdong-Hong Kong-Macao Greater Bay Area (GBA), more of the graduates are expected to stay in the area.
在毕业生就业方面，早期，毕业生一般就职于驻华国际律师事务所。渐渐的，毕业生也开始去国际和中国律所、政府机构和国际组织任职。费尔德曼教授强调，随着粤港澳大湾区受到更多关注，他期待更多毕业生留在大湾区工作。
Advancing the internationalization of SCIA
致力于推动深圳国际仲裁院国际化发展
Before his tenure at STL, Prof. Feldman worked at the U.S. Department of State for five years and led a team that represented the U.S. in investment treaty arbitration and provided legal counsel supporting the negotiation of U.S. bilateral investment treaties (BIT) and investment chapters of free trade agreements (including TPP and U.S.-China BIT negotiations).
加入北大国际法学院前，费尔德曼教授在美国国务院工作了五年。他带领的团队代表美国进行投资条约仲裁、提供关于美国双边投资条约和自由贸易协定投资谈判（包括跨太平洋伙伴关系协定和中美双边投资协定）的法律咨询。

Prof. Feldman also serves as an arbitrator with the Shenzhen Court of International Arbitration (SCIA), a position he has held for more than a decade. SCIA was established in 1983 as the first arbitration institution in the Guangdong-Hong Kong-Macao region after China’s reform and opening up. So far, it provides arbitration and mediation services for up to 140 countries and regions worldwide, and its panel of arbitrators covers 114 countries and regions. SCIA’s mission is to help Chinese and foreign parties to solve commercial disputes and constructing a just, fair, harmonious, and orderly business environment.
此外，费尔德曼教授还担任深圳国际仲裁院（SCIA）的仲裁员，这个职务他已经担任了十多年。深圳国际仲裁院成立于 1983 年，是中国改革开放后粤港澳地区首家仲裁机构。目前，深圳国际仲裁院为全球 140 个国家和地区提供仲裁和调解服务，其仲裁员覆盖114 个国家和地区。深圳国际仲裁院的使命是帮助中外当事人解决商事纠纷，构建公正、公平、和谐、有序的营商环境。

Originally from Detroit, Michigan, Prof. Feldman obtained his bachelor's degree from the University of Wisconsin-Madison. After that, he served as a Peace Corps volunteer in Lesotho, a landlocked country in southern Africa. A few years later, he went to the Columbia Law School in New York.
费尔德曼教授来自美国密歇根州底特律市，他在威斯康星大学麦迪逊分校获得学士学位。毕业后，他作为美国和平队志愿者在南非内陆国家莱索托工作了数年。几年后，进入纽约哥伦比亚大学法学院深造。
During his collaboration with the SCIA since 2011, Prof. Feldman has witnessed the SCIA expanding to multiple offices as well as its’ active role in rule making. “The SCIA has been active with developing rules on investment treaty arbitration, which is groundbreaking. Besides, the SCIA has a very international roster of arbitrators, including investment treaty arbitrators,” he explained.
2011年，费尔德曼教授开始与深圳国际仲裁院合作，他见证了深圳国际仲裁院设立了多个办事处，以及其在规则制定方面发挥出的积极作用。他解释说：“深圳国际仲裁院致力于投资条约仲裁规则的制定，这具有开创性意义。深圳国际仲裁院拥有国际化的仲裁员名单，包括投资条约仲裁员。”
Regarding investment treaty arbitration, Prof. Feldman supported SCIA’s development of expertise in the area by sharing his five-year experience representing the U.S. government in international investment disputes and collaborating with the SCIA on the development of a roster of arbitrators specializing in international investment disputes in 2016.
费尔德曼教授曾多次协助深圳国际仲裁院在投资条约仲裁领域进行探索。2016年，他曾与深国仲的同事们分享他代表政府处理国际投资争端的经验。同年，他与深国仲共同草拟了国际投资仲裁员名册。

In 2018, Prof. Feldman served as moderator for an event hosted by the SCIA in New York. In the same year, the International Chamber of Commerce (ICC) and the SCIA held a major event in Shenzhen on the enforcement of arbitral awards under a treaty known as the New York Convention.
2018 年，费尔德曼教授担任深圳国际仲裁院在纽约举办的一场专家小组讨论活动的主持人。同年，国际商会 (ICC) 和 深圳国际仲裁院在深圳联合举办了一场大型活动，主题是根据《纽约公约》执行仲裁裁决。
From Prof. Feldman’s perspective, it’s essential for the SCIA to have a global presence in order to participate in the international arbitration community. “The international arbitration community is a global community. I think the SCIA has really illustrated how they have reached out to many international institutions,” he pointed out.
费尔德曼教授认为，对深圳国际仲裁院来说，全球化至关重要，这关系到它能否参与国际仲裁社区。他指出：“国际仲裁社区是一个全球性的社区。深圳国际仲裁院用实际行动证明了其努力融入众多国际机构。”

For the internationalization of Shenzhen’s legal environment, Prof. Feldman suggested that step one should be assembling global talent, and then making the best use of that global talent. He mentioned the next step is more appointments of those international participants to actual cases.
就深圳怎样构建国际化的法律环境，费尔德曼教授建议，首先要汇集全球人才，然后要充分利用这些人才。特别应增加国际参与者在实际案例中的任职。
As a legal scholar and seasoned arbitrator, Prof. Feldman acknowledges the role of the Belt and Road Initiative (BRI) with respect to dispute resolution and prevention. “With respect to dispute resolution and prevention, the BRI creates a lot of opportunities. There's so much attention on the BRI and the development of dispute resolution, mechanisms and platforms that are tied to the BRI. It's a new landscape. For scholars, it gives us opportunities to think creatively about what future dispute resolution in the region might look like.
作为法学家、资深仲裁员，费尔德曼教授认为“一带一路”倡议（BRI）在争端解决和预防方面有着重要意义。费尔德曼教授指出：“在争端解决和预防方面，一带一路倡议创造了许多机会。人们非常关注一带一路倡议和相关争端解决机制和平台的发展。这是一个新的格局。对学者来说，这让我们有机会创造性地思考未来争端解决的可能性。”

The year 2023 marks the 10th anniversary of the BRI’s proposal. Prof. Feldman deems the BRI as a significant initiative introduced by China. “It’s an incredible innovation that the U.S. and the EU have reacted to. For any government or organization that really wants to have an impact, you should always be looking to innovate and introduce new initiatives,” he said.
2023 年是“一带一路”倡议提出 10 周年。费尔德曼教授认为，该倡议是中国推出的一项重要举措。“这是一个了不起的创新举措，引起了美国和欧盟的关注。对于任何真正想要产生影响的政府或组织来说，都应该始终寻求创新和推出新的倡议。”他说道。
Looking forward to more China-US exchanges
期待更多中美人文交流
Prof. Feldman said that he was glad to see China and the U.S. have agreed to increase international travel and direct flights, as well as greater student exchanges during Chinese President Xi Jinping and U.S. President Joe Biden’s meeting last November in San Francisco. “It's so important to have a lot of direct flights between the two jurisdictions and opportunities for face to face engagement. Because when you spend time together in person, it becomes so obvious that maybe we can make some progress,” he said.
费尔德曼教授很欣喜地看到，去年11月，中美两国元首在旧金山会晤达成的共识中，有增加两国直航航班和加强中美青年交流这两条。他表示：“这两点非常重要，只有当大家在一起直接交流，才能更容易发掘出共同进步的空间。”

The professor revealed to Shenzhen Daily that over the upcoming Chinese New Year, he will be in the U.S. and set up meetings with several top law schools to talk about opportunities for exchanges. “I plan to be meeting with people from top U.S. law schools and talking about opportunities of bringing more faculty and students to Shenzhen,” he mentioned.
费尔德曼教授告诉英文《深圳日报》，在即将到来的春节假期，他将赴美国与多所顶尖法学院交流访问。他说：“我计划讨论增加更多教职工和学生来深圳交流学习的机会。”
Prof. Fledman told Shenzhen Daily that he really likes Shenzhen as much as he likes New York for the two city’s urban environment and inclusiveness. “I like urban environments where there’s a lot of life on the street, and you can become a part of that life,” he said.
费尔德曼教授告诉记者，他非常喜欢深圳，就像喜欢纽约一样，这两座城市都有充满活力的城市环境和包容精神。他说：“我喜欢充满生活气息的城市，让我感觉自己也融入其中。”

He mentioned he likes the city’s welcoming spirit as implied in a famous saying “来了就是深圳人”(literally meaning “When you’re in Shenzhen, you’re a Shenzhener”). “I would translate it into ‘When you arrive in Shenzhen, you are already a Shenzhener.’ And that’s how I felt about New York when I arrived in 1996 for Columbia Law School, I immediately felt like this is home, this is my place,” he recalled.
这位教授表示，他很喜欢深圳“来了就是深圳人”这句话所传达的包容精神，并对此非常认同。“我会把它翻译成‘When you arrive in Shenzhen, you are already a Shenzhener’。这就是我在1996年初到纽约哥伦比亚大学法学院读书的感受，就像回到家一样。”他回忆道。
The professor said that he expects more young American students to come and visit Shenzhen, know more about the city, and fall in love with it.
他也期望有更多美国青年能够来深圳走走看看，了解并爱上这座城市。
